User Agreement

By accessing or using DigiMax ("we," "our," or "us"), you agree to be bound by the terms, policies, and conditions outlined in this User Agreement. If you do not accept these terms, you must immediately discontinue use of our services. This agreement governs your access to and use of DigiMax’s market data tools, educational content, and analytical signals, and it forms a legally binding contract between you and DigiMax.

Service Description

DigiMax operates as a proprietary, subscription-based platform offering curated OTC market data insights, analytical signal outputs, and educational resources intended for informational purposes only. We are not a brokerage, financial institution, or investment advisory service, and we do not handle or process client trading capital. Our tools are designed to assist in understanding potential market behaviours; they are not a promise, warranty, or guarantee of profits or outcomes.

Any visual charts, market previews, or demonstrations shared on our social media platforms (including but not limited to TikTok, Instagram, or YouTube) are for representational purposes only, illustrating potential theoretical accuracy under controlled conditions. These visual elements are non-functional, non-downloadable, and not offered as part of your subscription or purchase.

Payment & Access

Access to DigiMax content, signals, and tools is conditional upon successful payment for your chosen plan. All payments are processed through secure third-party gateways. You acknowledge and agree that:

• All payments are final and non-refundable, without exception, including but not limited to cases of technical issues, perceived dissatisfaction, or minimal usage.
• We reserve the right to modify subscription pricing, features, and access plans without prior notice. Any such changes will take effect on your next renewal or new purchase.
• Your subscription entitles you to personal, non-transferable, and limited access to our platform for the period purchased.

Communication

By signing up, you consent to receive service-related communications, including login credentials, system alerts, technical updates, promotional offers, and educational resources, through the email address you provided during registration. You acknowledge that:

• Delivery of emails may be impacted by your email provider’s spam or promotions filters, for which we bear no responsibility.
• You must ensure that your email is entered correctly during signup; incorrect entries may result in permanent non-delivery of account information.
• Unsubscribing from our communications may cause you to miss important updates or signals tied to your plan.

No Guarantee

DigiMax services are provided strictly on an “as is” and “as available” basis. We make no representations or warranties, express or implied, regarding:

• Signal accuracy, reliability, or timeliness.
• Platform uptime, uninterrupted access, or error-free performance.
• Market profitability, future results, or the achievement of any financial goal.

You understand that OTC markets and derivative trading carry inherent risks, including the complete loss of capital. You are solely responsible for any trading decisions you make based on DigiMax data, and you agree that we are not liable for any losses or damages incurred.

Termination

We reserve the absolute right, at our sole discretion and without prior notice, to suspend, restrict, or permanently terminate your account if:

• We detect account sharing, resale of access, or other prohibited conduct.
• We identify suspicious, fraudulent, or abusive activity in connection with your account.
• You breach any part of this User Agreement, our Privacy Policy, or any applicable law.

Upon termination, all rights to access DigiMax content and services immediately cease, and you will not be entitled to any refund or compensation.
